If you enter into discussions with your employer about leaving, the employer will make you a severance offer, usually in the form of a settlement agreement (termination document). Be aware that this is only the beginning of the negotiations. There is often more to be gained.

 

Most dismissals are settled by means of a settlement agreement.

More than 85% of dismissals are settled mutually through a so-called settlement agreement. The employer does not have to go to the UWV or the subdistrict court for a complex, time-consuming dismissal procedure. You also save yourself this procedure. This explains the popularity of the settlement agreement. The settlement agreement contains all the agreements regarding the dismissal, such as unemployment benefits, the amount of the transition allowance, notice period, etc. On average, there are 15 points on which agreements are made. When you receive a settlement agreement, you ask yourself: ‘Is this the maximum or is there more to be had?’

 

Settlement agreement is an initial proposal

A settlement agreement is also referred to as a dismissal proposal. This proposal is therefore not final. In fact, it is possible to negotiate a better proposal. Your position is often better than you think. Better conditions could include a higher transition payment. Experience shows that in 90% of cases, a better settlement and higher compensation are achievable. With permanent employment contracts, there is more room for negotiation than with temporary contracts.
